In this case, the buyer is liable to pay compensation for loss suffered and lost profit, which is fixed at a flat rate and irrevocably at 30% of the total value of the contract, without prejudice to the possibility of the seller to pursue the performance of the agreement and without prejudice to the possibility of the company to claim a higher compensation if the actual damage turns out to be higher than the fixed fixed amount of
